What This Privacy Policy Covers
This policy covers how YogiJim treats personal information that YogiJim collects and receives, including information related to your past use of YogiJim products and services. Personal information is information about you that is personally identifiable like your name, address, email address, or phone number, and that is not otherwise publicly available. This policy does not apply to the practices of companies that YogiJim does not own or control, or to people that YogiJim does not employ or manage. Parties to the Terms of Use Agreement
Visitors, subscribers, members, viewers, users, customers, or affiliates, collectively
referred to herein as "MEMBER(S)," are parties to this agreement. The website
and its owners and/or operators are parties to this agreement, herein referred
to as "YOGIJIM, INC."
Automatic Recurring Billing
Subscription fees may be automatically renewed at the end of the original term selected, for a similar period of time, unless notice is received from the subscriber seven days prior to renewal. All special introductory offer Members shall be exempt from the seven day notification requirement, but member must notify YOGIJIM, INC. directly, 24 hours prior to the end of the trial offer period to terminate the automatic renewal. All Trial members renew at the standard membership rate.
Unless and until this agreement is cancelled by the member in accordance to the terms above, MEMBER hereby authorizes YOGIJIM, INC. to charge MEMBER’S designated payment method to pay for the on going subscription and for any additional purchases made on YOGIJIM, INC.
Cancellation
Subscription to the service may be terminated anytime by either the MEMBER, or by YOGIJIM, INC. Cancellation may be made by visiting our Contact
Us page. When a MEMBER requests a cancellation, no further charges will accrue, however, the current subscription fees are NOT refunded. MEMBERS are liable for any charges incurred by them prior to the termination.
Sole Use
MEMBERS to YOGIJIM, INC. are granted a single seat license to YOGIJIM, INC. and its use is for that MEMBER only. All subscriptions are intended for personal use and should not be used for any commercial purposes. No material within the site may be copied, transferred, or otherwise delivered to any other person or entity. MEMBERS may not release their id and password to any other person.
Disputes
As part of the consideration that YOGIJIM, INC. requires for viewing, using or interacting with this website, MEMBER agrees to use binding arbitration for any claim, dispute, or controversy of any kind (whether in contract, tort or otherwise) arising out of or relating to this purchase, this product, including solicitation issues, privacy issues, and terms of use issues.
Arbitration shall be conducted pursuant to the rules of the American Arbitration Association which are in effect on the date a dispute is submitted to the American Arbitration Association. Information about the American Arbitration Association, its rules, and its forms are available from the American Arbitration Association, 335 Madison Avenue, Floor 10, New York, New York, 10017-4605. Hearing will take place in the county of Maricopa of the state of Arizona.
In no case shall the viewer, visitor, member, subscriber or customer have the right to go to court or have a jury trial. MEMBER will not have the right to engage in pre-trial discovery except as provided in the rules; you will not have the right to participate as a representative or member of any class of claimants pertaining to any claim subject to arbitration; the arbitrator's decision will be final and binding with limited rights of appeal.
The prevailing party shall be reimbursed by the other party for any and all costs associated with the dispute arbitration, including attorney fees, collection fees, investigation fees, travel expenses.
Jurisdiction and Venue
If any matter concerning this purchase shall be brought before a court of law, pre- or post-arbitration, MEMBER agrees to that the sole and proper jurisdiction to be the state of Arizona. In the event that litigation is in a federal court, the proper court shall be in the county of Maricopa of the state of Arizona.
Applicable Law
MEMBER agrees that the applicable law to be applied shall, in all cases, be that of the state of the Arizona.
Hyperlinking to site, Co-Branding, "Framing" and Referencing Site Prohibited
Unless expressly authorized by YOGIJIM, INC., no one may hyperlink to this site,
or portions thereof, (including, but not limited to, logotypes, trademarks, branding
or copyrighted material) for any reason. MEMBER specifically agrees to cooperate
with YOGIJIM, INC. to remove or de-activate any such activities and be liable
for all damages.
Severability
If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid or enforceable, then such a provision shall be deemed to be written, construed, and enforced as so limited.
